Asian Culture Center of TN Activity Participation and Release Agreement
Release of Liability
1. I hereby fully and forever release and discharge the Asian Culture Center of Tennessee (ACCTN) and all related entities, subsidiaries, affiliates, and their respective officers, directors, agents, contractors, representatives, employees, heirs, and assigns (individually and collectively, the “Releasees”) from any and all liability, claims, demands, actions, and causes of action of any kind or nature, known or unknown, arising out of or related to my participation in any ACCTN events, classes, or trips as an artist, student, exhibitor, or vendor (collectively, “the Activity”).
This release includes, without limitation, any claims arising from negligence or from the actions of other participants or visitors.
2. The ACCTN reserves the right, at its sole discretion, to remove any participant or patron exhibiting disruptive, unsafe, inappropriate, or unruly behavior.
3. Binding Effect and Assumption of Risk
It is my intent that this agreement shall be binding upon myself, my family members, spouse, heirs, assigns, guardians, and personal or legal representatives, both as to claims that may be asserted on my behalf and otherwise, and shall constitute a full and complete release by all such parties.
4. I understand and acknowledge that there are inherent risks involved in participating in the Activity, and I knowingly and voluntarily assume full responsibility for those risks.
5. This agreement shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to conflict-of-law principles. If any provision of this release is held invalid by a court of competent jurisdiction, the remainder shall continue in full force and effect.
6. Acknowledgment and Consent
By checking the box below, I acknowledge, represent, and warrant the following:
(a) I have read and fully understand this agreement and am signing it voluntarily;
(b) No oral statements, promises, or inducements have been made to me;
(c) This document contains the entire agreement between the parties;
(d) I am at least 18 years old, or I am the parent or legal guardian of a minor participant and have full authority to execute this release on the minor’s behalf; and
(e) I understand that the Releasees are relying upon my acknowledgments, representations, and warranties in permitting participation in the Activity.
7. Indemnification
I agree to indemnify, defend, and hold harmless the Releasees from and against any and all claims, demands, suits, liabilities, damages, losses, costs, or expenses (including attorney’s fees and court costs) that arise out of or relate to my or my family’s participation in the Activity, whether caused by the negligence of the Releasees or otherwise.
I further agree to indemnify and defend the Releasees if any of my acknowledgments or representations above are determined to be false.
8. Medical and Allergy Disclaimer
I understand that every reasonable effort will be made to avoid the use or exposure to foods or materials that may cause allergic reactions. However, I acknowledge that there is always a risk of accidental exposure. The Asian Culture Center of TN has explained these risks, and I agree that the organization will not be held liable for any accident, injury, or allergic reaction that may occur during participation.
9. Photo and Media Policy
By attending or participating in ACCTN events, I grant the Asian Culture Center of Tennessee a perpetual, royalty-free license to use photos, videos, and other media containing my image or likeness for promotional, educational, and informational purposes without additional consent or compensation.
Participants who do not wish to be photographed or recorded must notify event organizers upon arrival. ACCTN will make reasonable efforts to respect such requests.
The organization values privacy and will not sell or share personal data associated with any images or recordings.
